राष्ट्रपति शासन क्या होता है और ये कैसे लागू होता है?
नई दिल्ली 13 फरवरी 2024 को मणिपुर में राष्ट्रपति शासन लागू कर दिया गया। 1950 से अब तक देश के कई राज्यों में 134 बार यह लगाया जा चुका है। पहली बार 1951 में पंजाब में लागू किया गया था। मणिपुर-यूपी में सबसे ज्यादा 11 बार यह लगा है। जानते हैं क्या है राष्ट्रपति शासन और इसे कैसे लागू किया जाता है....
* राष्ट्रपति शासन को लेकर क्या प्रावधान हैं?
संविधान में 3 तरह की आपातकालीन स्थितियों का प्रावधान है। 1. राष्ट्रीय आपातकाल (अनुच्छेद 352)-युद्ध, बाहरी आक्रमण या सशस्त्र विद्रोह में लगता है। 2. राष्ट्रपति शासन (अनुच्छेद 356) जब राज्य सरकार संविधान के अनुसार काम नहीं करतीं। 3. वित्तीय आपातकाल (अनुच्छेद 360) आर्थिक संकट की स्थिति में लगता है।
* अनुच्छेद 356 लागू होने पर क्या होता है? जब राष्ट्रपति को लगता है कि राज्य सरकार संविधान के
अनुसार काम नहीं कर रही है, तो वह राष्ट्रपति शासन लागू कर सकते हैं। लागू होने के बाद, राज्य की कार्यकारी शक्ति केंद्र सरकार को सौंप दी जाती है और विधानसभा का नियंत्रण संसद के पास चला जाता है।
* मौलिक अधिकार पर क्या प्रभाव पड़ता है?
राष्ट्रपति शासन लागू होने पर लोगों के मौलिक अधिकार प्रभावित नहीं होते। हालांकि, राष्ट्रीय आपातकाल लागू होने पर अनुच्छेद 19 (स्वतंत्रता का अधिकार) निलंबित हो जाता है। राष्ट्रपति शासन में राष्ट्रपति के प्रतिनिधि के रूप में राज्यपाल काम करते हैं।
* यह कितने दिनों तक लागू रह सकता है?
राष्ट्रपति शासन के आदेश के दो महीने के भीतर संसद से मंजूर कराना जरूरी होता है। यह अधिकतम 3 साल तक बढ़ सकता है, लेकिन इसके लिए हर छह महीने में संसद से मंजूरी लेनी होती है। यह एक साल से ज्यादा तभी बढ़ाया जा सकता है... जब देश में राष्ट्रीय आपातकाल लागू हो। चुनाव आयोग यह प्रमाणित करे कि राज्य में चुनाव कराना संभव नहीं है।

What are the provisions regarding President's rule?
There are provisions for 3 types of emergency situations in the Constitution. 1. National Emergency (Article 352) - imposed in case of war, external aggression or armed rebellion. 2. President's Rule (Article 356) - imposed when the state government does not work according to the Constitution. 3. Financial Emergency (Article 360) - imposed in case of economic crisis.
What happens when Article 356 is invoked? When the President feels that the state government is not functioning according to the Constitution, he can impose President's rule. After implementation, the executive power of the state is handed over to the central government and the control of the assembly goes to the Parliament.
What is the impact on Fundamental Rights?
The fundamental rights of the people are not affected when President's rule is imposed. However, Article 19 (Right to Freedom) is suspended when a national emergency is imposed. The Governor acts as the representative of the President during President's rule.
For how long can it remain in force?
It is necessary to get approval from the Parliament within two months of the President's rule order. It can be extended up to a maximum of 3 years, but for this approval from the Parliament has to be taken every six months. It can be extended for more than one year only... when a national emergency is imposed in the country. The Election Commission certifies that it is not possible to conduct elections in the state.
